Many people believe that they no longer qualify for bankruptcy protection - this may not be true. The changes in the Federal Bankruptcy Law shifted the process and added many steps to the process but most folks can still find relief in the Bankruptcy Code.

The Bankruptcy Law Changes - October 2005

In October of 2005 Congress passed a law "The Bankruptcy Abuse Prevention and Consumer Protection Act" that changed the way the Bankruptcy Code operates. You might remember the news stories with the long lines of people rushing to file before the law changed. This changed was lobbied for and written by the consumer lenders and their supporters in Congress. The same people who can change your interest rate if your payment is one day late - want to make it harder for you to exercise your rights in Court! 

One of the key changes was that people, who had come to understand the rules and used them, was that people became uncertain if they could seek protection under the law and so many have not exercised their rights to do so. This is combined with new call center technology which allows credit card companies, auto loan companies to come into your house each night as you eat dinner to hound you on a late payment call. Many companies uses systems that automatically call you 3-4 times each hour only to have you hold on for a real person after you answer. There is a better way.

If your income stream does not support you bills and you cannot work out payment plans with your creditors you may need a bankruptcy proceeding. This is calla means test.

Anyone Seeking Protection Under Chapter 7 or Chapter 13 of the Bankruptcy Code MUST complete a Means Test. The Means Test is really a series of questions. These questions are to help determine if you have sufficient income to fund a bankruptcy plan under Chapter 13 - if you have enough "disposable" income to work down your debt. If you don't - you fail the means test - you may proceed in Chapter 7.
